A business owner in the Town of Farmington has filed a lawsuit in federal court over a county decision to not allow an off-site parking lot. Jeff Maiman, owner of the Wheelhouse, wants the U.S. Eastern District Court of Wisconsin to rule that his restaurant’s off-site parking lot is a legal, non-conforming use under the county’s zoning code. The suit says Maiman only purchased the property after he was assured by county officials that he could use a portion of it for parking. But in May of this year, amendments to the zoning code, including that a parking lot be within 500 feet of the business it serves, were approved. The Wheelhouse lot does not meet the new standards. Meanwhile, countersuits between Maiman and the county are pending in Waupaca County Circuit Court.
