A Waupaca man is being held on a 2000 dollar cash bond following a felony drunk driving charge in Waupaca County Circuit Court. 55 year old David R. Pendergast is facing his 6th operating while intoxicated offense, along with a count of operating after revocation. The criminal complaint says Pendergast was arrested Wednesday in Waupaca. The complaint alleges police found him behind the wheel of his vehicle stopped in traffic on Randall Street, with the car in drive. The complaint alleges he could not get himself out of the vehicle. The complaint says he was taken to ThedaCare– Waupaca Hospital for a blood draw, and was held there due to what the complaint alleges was a “high level of intoxication.” Court records show Pendergast has 5 prior drunk driving convictions dating back to 1995. If convicted on this 6th offense, he could face up to 10 years in prison. He is due back in court tomorrow.
