An Ogdensburg man is being held on a 10-thousand dollar cash bond following a felony drunk driving charge in Waupaca County Circuit Court. 53 year old Deniel B. Smith is facing his 5th operating while intoxicated offense, along with two felony bail jumping counts, and a count of operating while revoked. The criminal complaint alleges Smith was intoxicated Tuesday afternoon when he drove his car off County Hiway E into a steep ditch north of Waupaca. The complaint says he refused field sobriety tests, but a preliminary breath test taken at the jail allegedly showed a .320 blood-alcohol concentration. Smith has 3 prior drunk driving convictions dating back to 1990, and a 4th offense drunk driving charge is still moving through the court system after he was charged with that in July. If convicted on these latest charges, he could face up to 22 years in prison. Smith is due back in court next Tuesday.
